New Louisiana Law Makes NDAs in Civil Child Sex Abuse Settlements Unenforceable

Enacted in mid-May by Louisiana Governor Jeff Landry, Act 251 nullifies non-disclosure agreements within civil settlements involving victims of child sexual abuse. This will allow the victim the opportunity to tell their story.
Act 251 applies only to civil settlements pertaining to victims of child sex abuse. Because the Act is retroactive, NDAs from the past are no longer legally binding.
Earlier this year, Texas and Missouri enacted matching versions of this law. Elizabeth Carlock Phillips, who is the sister of child sexual abuse survivor Trey Carlock, has partnered with Senator Ted Cruz to push for federal legislation to introduce a federal equivalent. This type of legislation is also known as “Trey’s Law” in his memory.
