Lamothe Law Firm Attorney Wins in Court

by Kristi S. Schubert

Less than a year ago, the Louisiana Supreme Court ruled that the Louisiana Lookback Window, a law which revived all previously expired childhood sexual abuse claims in Louisiana, is constitutional.

Despite that conclusive ruling by the Louisiana Supreme Court, the Diocese of Houma-Thibodaux recently raised new attacks on the constitutionality of the Lookback Window law.

The Diocese is now claiming that the Lookback Window law is unfair and unconstitutional because it will cost them too much money and, therefore, violates the takings clauses of the United States and Louisiana Constitutions.

The Houma-Thobodaux Diocese also argued that if the court will not strike the Lookback Window law down as unconstitutional, the court should force the taxpayers of the State of Louisiana to reimburse the Diocese for all the money that it might end up paying out to abuse survivors.

In other words, the Diocese has asked the court to set up a pedophile bailout fund.

Just weeks ago, Lamothe Law Firm attorney Kristi Schubert defeated this argument in state court. While it is expected that the Diocese of Houma-Thibodaux will continue to fight, the Lamothe Law Firm will continue to fight as well.
